Since August 2024 buyer-side compensation is no longer offered through the MLS and is negotiated directly in a written agreement with the buyer, which changed what this invoice is. It now has to name the agreement it is billed under and the side it represents, because the closing table no longer assumes where the money comes from.

What to put on a real estate commission invoice
- The property address, the closing date and the transaction or file number
- Which side you represented, and the written agreement the compensation is set by
- The commission as a rate against the sale price, or as the flat fee agreed
- Any brokerage split, so the figure reaching the agent is not confused with the gross
- Referral fees owed to another brokerage, as their own line
- Transaction or compliance fees, which closing agents will ask you to identify
Questions
What changed for buyer-side commission in 2024?
Offers of compensation can no longer be published on the MLS, and agents working with a buyer must have a written agreement, signed before touring, that states the compensation or how it will be determined. Compensation can still be paid by a seller or a listing broker — it is simply negotiated outside the MLS rather than advertised inside it.
Should the invoice name the buyer agreement?
Yes. It is now the document that establishes what you are owed and by whom, so a closing agent reconciling the settlement statement will look for it. An invoice that refers only to "standard commission" no longer refers to anything.
How should a referral fee be shown?
As its own line against the gross commission, with the receiving brokerage named. Referral fees are paid brokerage to brokerage, and netting them off quietly makes the settlement statement disagree with your own records.
